Welcome to the Celiac India & Beyond Foundation’s website (the “Site”) which is owned and operated by Celiac India & Beyond Foundation  (collectively, “Celiac India”, “We”, “Us”, or “Our”). The website, www.celiacindia.org.in (“Site”) has been developed to promote wellness amongst persons with celiac disease and their families. It is a free service that promotes the understanding of Celiac disease and how to manage it.

Please read these terms of use (“Terms of Use”) carefully before using the services of this Site. These Terms of Use set forth the legally binding terms and conditions for your use of this Site and all related content you peruse on the Site.Your access and use of the Site will be subject to the version of the Terms of Use posted on the Site at the time of use. Further, by accessing or using this Site, you agree to these Terms of Use, conditions and all applicable laws.If you do not agree with the Terms of Use, then you do not have the right to access, view, download or otherwise use the Site and, accordingly, you should not do so.

 

1 Use of website

1.1. Unless otherwise specified, the Site is for your personal and non-commercial use.You agree to use the Site only for lawful purposes and in compliance with all applicable laws. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from,whether in part or in whole or in any media, print or electronic form, or transfer or sell any information or services obtained from the Site.

1.2. In case of non-compliance with the provisions of the Terms of Use hereto, we reserve the right to suspend your access to the Site. In such a case, we will inform you as soon as possible about your being prohibited from accessing the Site.

1.3. While we strive to keep the Site accessible at all times, we can not guarantee access in all circumstances. Indeed, for reasons including maintenance, upgrade, or for any other reason that are beyond our control, access to the Site may be interrupted.

 

2 Intellectual Property Rights

2.1.  All copyright and other intellectual property rights in all text, images, sound, software, videos and other materials on this Site are owned by Celiac India & Beyond Foundation or are included with permission of the relevant owner, as per Indian Copyright Act, 1957.

2.2. You are permitted to browse this Site and to downloaded content which has been specifically marked and available as pdf documents. You are welcome to download such information and use the same for yourself or your patients. However, all such information must be downloaded and reproduced in whole along with the logo and reference must be made to celiacindia.org.in. The ownership right of the downloaded material remains with Celiac India & Beyond Foundation. The information shall not be modified or incorporated in any other work, publication or site, whether in hard copy or electronic format, including posting to any other Site. No other licence or right is granted.

2.3. All trade marks displayed on this Site are either owned by or used under a licence by Celiac India & Beyond Foundation, as per the terms of Indian Trade Marks Act, 1999.This includes the logo, the words – “Gluten free & beyond”, the interview content with experts amongst the other material, images and videos.

2.4. Any use of the content not expressly permitted by this provision is a breach of these Terms of Use and may violate copyright, trademark, and other intellectual property laws.

 

3 Content

3.1. The information on this Sitesuch as text, graphics, imagesand videos has been included in good faith and is for general informational purposes only. It should not be relied on for any specific purpose and no representation or warranty is given in relation to its accuracy or completeness.

3.2. The information on this Site is not a substitute for advice, diagnosis, or treatment by your physician and/or nutritionist. Content, images or any other information in any part of the Site, whether stated by us or as part of any of our interaction with experts should not replace a medical advise by your doctor or healthcare provider. Therefore, the author does not guarantee satisfaction from following such advice and assumes no liability for your use of the same.Your doctor’s word regarding the diagnosis and treatment or any other aspect of the disease or related conditions should be final.

3.3. As medicine is an evolving field, new content is being constantly added and old ones modified. The authors take special precaution to mention relevant and up to date information. You are requested to check the Site for latest information before using any data or information from this Site. Please remember that it cannot be a substitute for advice from a physician or nutritionist.

3.4. This Site promotes wellbeing amongst celiacs and we have brought in views of experts from different fields dealing with various aspects of celiac disease in India and abroad. This would include interviews, chats, question and answers, tips, etc. from them. The opinions, advice, facts and all such information contained therein are their views and not necessarily endorsed by us. Reliance on any information provided by such experts appearing on the website or any other visitors to the website is solely at your own risk. The content in these interactions should be read and used keeping in mind that some views maybe relevant in the legal and social context of their countries and not ours. Ingredients, products mentioned in these may be gluten free in their countries and not ours. This needs to be understood before consuming any of these products or using any recipes or other details mentioned therein. We also do not endorse the establishments they are associated with, as gluten free. The user has to ask all questions and ensure his safety if and when dining in these establishments. Any damage arising out of reliance on information provided here is at your own risk.

3.5.  Interviews with food manufacturers are being provided on this Site only to provide information to the patients to help make informed choices. It is only a representation of facts as stated by them. We cannot verify the claims made by them and we do not endorse, promote or discourage the use of these products. Reliance on any information provided by such food manufacturers appearing on the Site is solely at your own risk. Usage or discontinuation of usage of these products is solely at the discretion of the consumer. Any damage arising out of usage of any product mentioned here is the sole responsibility of the user.

3.6. In an effort to provide more choices to celiac community, we are interacting with food industry to make them aware of the need for gluten-free food. These celiac friendly organisations are listed on the Site. Please note that this is only an awareness program and not a gluten free certification program and cannot be construed or deemed as one. Any damage arising out of food ordered and consumed in these outlets is between the parties concerned with no involvement or liability whatsoever of Celiac India & Beyond Foundation.

3.7.  We reserve the right to make any changes and corrections to the content on this Site as and when we consider it appropriate and without notice.

4.1. In order to provide information relevant to a celiac patient. this Site may contain links to other websites on the Internet that are owned and operated by third parties (“External Sites“). However, even if the third party is affiliated with Celiac India & Beyond Foundation, Celiac India & Beyond Foundation has no control over these External Sites, all of which have separate privacy and data collection practices. Celiac India has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such External Sites. These External Sites are only for your convenience and therefore you are advised to access them at your own risk.

8 DISPUTES

8.1.  Any dispute or claim arising out your visit to the Site shall be referred to the sole arbitrator appointed by Celiac India & Beyond Foundation in accordance with the law. The venue of such arbitration shall be at New Delhi, India and the award of the arbitrator shall be final and binding on all parties.To the extent arbitration is not permitted by applicable law, any dispute relating in any way to your visit to the Site shall be submitted to an appropriate court or other judicial body in India, as applicable, without prejudice to the applicable law and all applicable provisions of this provision, and subject to our right to seek injunctive or other appropriate relief in any court, if you have in any manner violated or threatened to violate our intellectual property rights and you consent to exclusive jurisdiction and venue in such courts.

8.2. With respect to any dispute regarding the Site, all rights and obligations and all actions contemplated by these Terms of Use shall be heard before the courts of New Delhi, India, as if the Terms of Use were a contract wholly entered into and wholly performed within New Delhi, India, subject to foreign legal mandatory provisions.

10.1. The Terms of Use herein shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in New Delhi.

10.2. Celiac India & Beyond Foundation makes no representation that materials / productson the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal or is prohibited. Those who choose to access this Site from locations outside Indiamay do so on their own initiative and are responsible for compliance with applicable local laws.

 

11 Changes to Terms of Use

11.1. Celiac India & Beyond Foundation may revise these Terms of Use at any time by updating this posting. You should visit this page from time to time to review the current Terms of Use because the same shall be binding on you.

 

12 General

12.1. If any provision of these Terms of Use is found to be unenforceable or invalid, the remaining provisions of these Terms of Use shall be unaffected thereby and shall remain in full force and effect to the fullest extent permitted by applicable law.
